Terms of service

Introduction

1. This Terms of Service defines the terms and conditions for the provision of kimono rental services and related services (hereinafter referred to as "the Services") provided by Yuzen-an Co., Ltd. (hereinafter referred to as "the Company") at its various stores.
2. Users of the Services (hereinafter referred to as "Users") are required to agree to all the terms of this agreement, as well as all information provided on the Company's website (hereinafter collectively referred to as the "Terms and Conditions").
3. In case of any disputes related to the Services, the parties shall engage in discussions based on these Terms and Conditions. Matters not covered by these Terms and Conditions shall be handled in accordance with the information provided at the service location, applicable laws, or general customs.
4. The Services are intended for personal enjoyment and hobby purposes. Users are not allowed to use the kimonos provided by the Company for commercial purposes or in salons or specific gatherings without the Company's prior permission. If Users wish to use the kimonos in such a manner, they must notify the Company at least two weeks in advance, and fees will be discussed based on the nature of the use.
5. The Services are not available for pregnant individuals. If a User is pregnant and fails to inform the Company in advance, the Company will not assume any responsibility for any issues that may arise.

 

Reservation Procedure

1. Users are required, in principle, to input necessary information on the Company's website and make a reservation for the Services.
2. After receiving the reservation request, the Company will confirm the reservation by displaying it on its website and sending a confirmation email to the User. The contract is considered established upon the Company's dispatch of the confirmation email.
3. If the Company conducts a reservation for the Services through phone, email, or in-person, it will provide separate instructions on the Company's website, and Users are expected to follow those instructions.

 

Service Reception and Provision Hours

1. The service hours are as specified on each store's website.
2. The Services cannot be provided to individuals who arrive outside the reservation time. Users are required to arrive at the scheduled time.
3. Outside the service hours, the Services, as well as luggage storage or retrieval, are not available. However, for users of the next-day return service, luggage will be held until the kimono return.
4. For the safety of Users, in the event of heavy rain (landslides, flooding), floods, storms, blizzards, or heavy snow warnings issued within 2 hours before the start of business in the respective store's city, the store will be closed, and the Services will not be provided. In this case, the Company will not be liable for any disadvantage suffered by the User due to force majeure.

 

Content and Usage Fees of the Services

1. The content, usage fees, and payment methods of the Services are as specified on the Company's website.
2. The Company may revise the content, usage fees, and payment methods of the Services without prior notice, and Users are required to check the latest information on the Company's website before applying for the Services.

 

Late Fees for the Services

1. If a User fails to return to the store on time, an extension fee of ¥1,100 per person for every 10 minutes will be charged.
2. Users who cannot return on time without prior notice and obtaining the understanding of the staff will result in the store closing at the scheduled end time. Returns will be scheduled for the next day, and the same amount as the dressing fee paid on the same day will be charged as a late fee.
3. Late fees mentioned above will be settled in cash at the store.

 

Items Not Accepted for Storage

1. The Company assumes that items kept in storage are limited to clothing, and it cannot accept the following items due to the inability to store them securely:
2. Valuables (house or car keys, expensive clothing or bags, jewelry, watches, cash, passports, etc.)
3. Electronic devices (computers, cameras, game consoles, tablets, etc.)
4. Explosive, flammable, or other hazardous items
5. Living organisms, frozen or refrigerated items, fresh produce, flowers, and other items prone to leakage or deterioration
6. Items contrary to public morals (illegal drugs, etc.)
7. Fragile and easily deformable items
8. Items that cannot be laid flat
9. Other items that the Company deems difficult to store
10. Despite the above, if a User wishes to store items listed in the preceding paragraph, the User acknowledges in advance that the Company is not responsible for any loss (including theft), damage, or leakage of these items.

 

Handling of Lost Items

If the Company finds a User's lost item within its store, it will handle it as follows, and the User agrees to these terms:
1. For lost items such as passports, driver's licenses, credit cards, cash, or precious metals like jewelry, the Company will report them to the nearest police station. The Company will only return them to the User in-person if there is prior contact from the User before reporting to the police. Postal returns will not be provided.
2. For lost items other than those mentioned above, if there is no contact from the User within one week of the Company's discovery of the lost item, ownership will be deemed abandoned, and the Company will dispose of the item. If the User contacts within the specified period, the item will be returned by cash-on-delivery mail. The shipping date will be determined by the Company's convenience.

 

Prohibited Actions by Users

1. Users are prohibited from engaging in the following actions when using the Services:
2. Acts that violate laws and regulations
3. Acts that may harm public order or morals
4. Using the Services in a manner other than the methods specified by the Company
5. Other actions that violate these Terms and Conditions
6. If a User engages in any of the prohibited actions mentioned in the preceding paragraph, the Company may, without prior notice, suspend or terminate the provision of all or part of the Services at any time.
7. The Company may request a User who engages in the prohibited actions mentioned in the first paragraph to cease such actions, and if the Company incurs damages due to such actions, it may seek compensation.

 

Suspension or Discontinuation of the Service

1. The Company may temporarily suspend the entire or partial provision of the Services without notifying customers in the following cases:
1. Inspection, maintenance, construction, or other necessary work on the systems or facilities required for providing the Services
2. Emergencies such as fire, accidents, power outages, natural disasters, war, terrorism, riots, labor disputes, or other urgent situations that make it difficult to provide the Services
3. Legal or administrative measures make it difficult to provide the Services
4. Other situations where the Company deems it necessary to temporarily suspend the provision of the Services
5. If the Company determines that the continuous provision of the Services is difficult or that it is necessary to discontinue the Services for operational reasons, the Company may discontinue the provision of the Services due to unavoidable circumstances.
6. If the Company suspends or discontinues the provision of the Services, the Company will refund Users the portion of

the usage fees paid for services that could not be provided due to the suspension or discontinuation.

 

Termination of the Contract

1. If a User wishes to cancel a reservation, they must complete the cancellation procedure by 5:00 pm the day before the reservation date.
2. If a User is late for the reserved time, it may be treated as a same-day cancellation.
3. If a User feels unwell during the dressing process or if pregnancy is discovered during the dressing process, it will be treated as a same-day cancellation.
4. In the case of a same-day cancellation, fees already paid cannot be refunded.
5. The Company may terminate the contract without prior notice if a User falls under any of the following:
6. Violation of any of the prohibitions specified in these Terms and Conditions
7. Actions related to the Services by the User that may violate laws or public morals
8. Discovery that the User or their companions are affiliated with antisocial forces as defined in Article 12
9. Non-payment of the usage fees for the Services by the User by the specified due date

 

Disclaimer

1. The Company is not responsible for any damages incurred by Users in connection with the provision of the Services, except in cases of intentional or gross negligence on the part of the Company.
2. In particular, the Company is not responsible for the following cases, as negligence on the part of the Company is generally not recognized:
2. Color transfer caused by the material or paint of the luggage compartment adhering to the contents of the luggage. (Users are responsible for protecting items prone to color transfer with plastic bags, etc.)
3. Damage caused by the fall and breakage of electronic devices inside clothing when Company staff assists with dressing or undressing. (Users are responsible for storing electronic devices securely during dressing or undressing.)
4. Delays in the provision of the Services due to reasons such as congestion, causing delays in planned activities such as sightseeing, meals, or performances. (Delivery times cannot be guaranteed, so please make reservations with ample time.)
5. Skin irritation, rash (hives, etc.), infectious diseases, etc. (The Company provides clothing for rental to an unspecified number of users and exercises reasonable and appropriate management. However, due to the unclear causal relationship between the Services and skin irritation, rash, infectious diseases, etc., the Company cannot be held responsible.)
6. Falling outside the store. (Falling outside the store is influenced by road conditions, the User's walking style, and other factors beyond the Company's control, so the Company assumes no responsibility.)
7. Injuries, burns, or other accidents that may occur if a User does not follow store notices, employee instructions, or guidance and falls, gets burned, or injured inside the store. (In such cases, it is the User's fault, and the Company is not responsible. Especially during hair setting, using high-temperature devices for treatment carries the risk of burns from hair irons, so it is advised to remain still and follow the staff's instructions.)
8. Loss or alteration of hand luggage due to natural disasters or other force majeure events
9. Other damages to Users caused by reasons beyond the Company's control (For example, burns from a heater, degradation of hair extensions due to hair setting, discoloration of coloring due to a hair iron; the Company cannot be held responsible for such reasons.)
10. The Company is only liable for damages directly and normally incurred (excluding lost profits), and the compensation amount is limited to ¥10,000 for such damages.

 

Handling of Personal Information

The Company will handle personal information obtained in connection with the Services appropriately in accordance with its privacy policy.

 

Changes to Terms of Service and Services

These Terms of Service may be changed, added, or deleted without notice. Users will not receive individual notifications. It is the User's responsibility to check the latest "Service Terms of Use" before using the Services.

 

Governing Law and Jurisdiction

These Terms of Service are governed by Japanese law, and any disputes arising from these Terms of Service will be subject to the exclusive jurisdiction of the Kyoto District Court.
